On June 22nd, 2017 Sears Canada Inc. (“Sears Canada”), Corbeil Électrique Inc., S.L.H. Transport Inc., The Cut Inc., Sears Contact Services Inc., Initium Logistics Services Inc., Initium Commerce Labs Inc., Initium Trading and Sourcing Corp., Sears Floor Covering Centres Inc., 173470 Canada Inc., 2497089 Ontario Inc., 6988741 Canada Inc., 10011711 Canada Inc., 1592580 Ontario Limited., 955041 Alberta Ltd., 4201531 Canada Inc., 168886 Canada Inc., and 3339611 Canada Inc. (together, the “Applicants” or the “Sears Canada Group”) sought and obtained an order (as amended from time to time, the (“Initial Order “)) under the Companies' Creditors Arrangement Act (the "CCAA") from the Ontario Superior Court of Justice (Commercial List). Pursuant to the Initial Order, FTI Consulting Canada Inc. (“FTI” or the “Monitor”) has been appointed Monitor. The Initial Order also provides for a stay of proceedings for an initial thirty (30) day period subject to further extensions by the Court, (the Stay of Proceedings”).

Inc., The Cut Inc., Services Clientèle Sears Inc., Initium Logistics Services Inc., Initium Commerce Labs Inc., Initium Trading and Sourcing Corp., Centres de Revêtements de Sol Sears Inc. / Sears Floor Covering Centres Inc., 173470 Canada Inc., 2497089 Ontario Inc., 6988741 Canada Inc., 10011711 Canada Inc., 1592580 Ontario Limited., 955041 Alberta Ltd., 4201531 Canada Inc., 168886 Canada Inc. et 3339611 Canada Inc. (ensemble, « demandeurs » ou « Groupe Sears Canada ») ont demandé et obtenu une ordonnance (en sa version modifiée de temps à autre, « ordonnance initiale ») de la Cour supérieure de l’Ontario (Chambre commerciale) en vertu de la Loi sur les arrangements avec les créanciers des compagnies (« LACC »). Conformément à l’ordonnance initiale, FTI Consulting Canada Inc. (« FTI » ou « contrôleur ») a été nommée contrôleur. L’ordonnance initiale prévoit également la suspension des procédures pendant une période initiale de trente (30) jours, qui peut être prolongée de temps à autre par le tribunal (« suspension des procédures relatives au Groupe Sears Canada »).

On October 25, 2021, the Honourable Mr. Justice Hainey granted an Order extending the Stay Period until and including the CCAA Termination Time.

Le 25 octobre 2021, l'honorable juge Hainey a accordé une ordonnance prorogeant la période de suspension jusqu'à et y compris l'heure de résiliation de la LACC.

On January 7, 2022, the Monitor served the Notice of Final Distribution on the Service List to inform the Creditors that the Monitor intends to effect a final distribution under the Amended and Restated Joint Plan of Compromise and Arrangement of Sears Canada Inc. and certain of its affiliates (the "Plan") on or around Friday, April 8, 2022. The Monitor reserves the right to make final distributions under the Plan in advance of such date if final distribution amounts can be determined in advance of that date.

All notices from Creditors seeking to recover an Undeliverable Distribution (as defined in the Plan) must be made to the Monitor in writing at the address set out in the Notice of Final Distribution on or before 5:00 p.m. on March 8, 2022. Creditors are referred to and strongly encouraged to read the Notice of Final Distribution for details.

Le 7 janvier 2022, le Contrôleur a signifié l’Avis de la Distribution finale aux entités figurant sur la Liste de signification afin d’informer les Créanciers que le Contrôleur a l’intention de faire une distribution finale aux termes du Plan de transaction et d’arrangement conjoint modifié et mis à jour de Sears Canada Inc. et de certains membres de son groupe (« Plan ») vers le vendredi 8 avril 2022.

Tous les avis de la part des Créanciers qui souhaitent récupérer une Distribution non livrée (au sens défini dans le Plan) doivent être faits par écrit et transmis au Contrôleur à l’adresse indiquée dans l’Avis de la Distribution finale au plus tard à 17 h le 8 mars 2022. Il est vivement recommandé aux Créanciers de consulter l’Avis de la Distribution finale pour de plus amples renseignements.
