Non-PRC Claims Package for Retirees not represented by Retiree Representative Counsel [2] Non-PRC Retiree Claims Package - English Non-PRC Retiree Claims Package - French [1] Pursuant to an order issued by the Court on July 13, 2017 (the "Pension Representative Counsel Order"), Koskie Minsky LLP was appointed representative counsel ("Pension Representative Counsel") to represent the interests of the non-unionized retirees and non-unionized active and former employees of the Sears Canada Entities ("PRC Retirees") with respect to (i) entitlements under the Sears Pension Plan, the Supplemental Plan, and any other pension or retirement plan of the Sears Canada Entities, and (ii) other post-employment benefit entitlements including health, dental and life insurance ("OPEBs"). Unless you are unionized active or former employee, a unionized retiree, a member of senior management that was not eligible to be represented by Pension Representative Counsel, or if you were eligible, but you notified the Monitor that you have opted out of being represented by Pension Representative Counsel, than you are represented by Pension Representative Counsel (a "PRC Retiree"). [2] A Non-PRC Retiree means any retiree with entitlements to health/dental and or life insurance benefits ("OPEB Entitlements") who is not represented by Pension Representative Counsel, including without limitation: (i) any unionized Retiree who notifies Pension Representative Counsel in writing that such Retiree wishes to opt out of representation by Pension Representative Counsel;(ii) any Retiree who is currently or was previously a member of senior management of any of the Sears Canada Entities and who was not eligible for representation by Pension Representative Counsel, and (iii) any Retiree who was eligible for representation by Pension Representative Counsel and who opted out of such representation in accordance with the requirements contained in the Pension Representative Counsel Order
