Non-ERC Claims Package for Employees not represented by Employee Representative Counsel [2] Non-ERC Employee Claims Package - English Non-ERC Employee Claims Package - French [1] Pursuant to an order issued by the Court on July 13, 2017 (the "Employee Representative Counsel Order"), Ursel Phillips Fellows Hopkinson LLP was appointed representative counsel ("Employee Representative Counsel") to the non-unionized active and former employees, other than senior management, of the Sears Canada Entities. If you are an active or former non-unionized employee of the Sears Canada Entities, and you are not a member of senior management, nor did you notify the Monitor that you have opted out of being represented by Employee Representative Counsel, than you are represented by Employee Representative Counsel (a "ERC Employee"). [2] Employees who are not represented by Employee Representative Counsel ("Non-ERC Employees") include: (i) Unionized Employees; (ii) any Employee who is currently or was previously a member of senior management of any of the Sears Canada Entities and who was not eligible for representation by Employee Representative Counsel; and (iii) any Employee who was eligible for representation by Employee Representative Counsel and who opted out of such representation in accordance with the requirements contained in the Employee Representative Counsel Order.
