The ninth report from the Monitor includes events in the Chapter 11 Proceedings since March 15, 2010, Correspondence with counsel to the Required Lenders and counsel to the Backstop Parties in respect of potential employee bonus payments, the implementation of the SISP, the status of the Applicant’s efforts to obtain Exit Financing, the Applicant’s request for approval of the Claims Procedure, the Applicant’s request for approval of the Rothschild Engagement Terms, and the Applicant’s request for the Applicant’s obligations to Rothschild to be secured by the existing Administration Charge.

To seek court approval of a Claims Procedure, and update the court on various ongoing business of the Applicant.

 Monitor's Fourth Report December 1, 2009
Monitor’s Fourth Report includes an update on the Applicant’s progress with respect to arranging DIP finance, a restructuring plan, the Nexen agreement, proposals received for acquisition of certain assets, payments made under paragraph 13 of the Amended and Restated Initial Order, a revised cash flow forecast and a request for approval of an extension of the Stay period to January 15, 2010.
