FTI Consulting, Inc. / Myra Falls Mine Ltd.
On December 18, 2023, Myra Falls Mine Ltd. ("MFM") sought and obtained an initial order (the "Initial Order") from the Supreme Court of British Columbia (the "Court") under the Companies' Creditors Arrangement Act R.S.C. 1985, c. C-36, as amended ("CCAA"). The Initial Order provides, among other things, a stay of proceedings which may be extended from time to time. Pursuant to the Initial Order FTI Consulting Canada Inc. was appointed monitor (the "Monitor") of MFM. On December 28, 2023, MFM obtained an amended and restated initial order (the "ARIO") extending the period of the Court-ordered stay of proceedings against MFM under the CCAA until February 29, 2024 (the "Stay Period"). On February 27, 2024, MFM obtained an order approving the Sale and Investment Solicitation Process (the "SISP"). Please refer to the Sale and Investment Solicitation Process section of this website for further information. On February 27, 2024, MFM obtained an order extending the Stay Period until and including June 30, 2024. On March 7, 2024, MFM obtained an order approving an agreement for the sale of MFM's right, title and interest in an equipment lease. On April 3, 2025, MFM obtained an order approving the Stalking Horse and Second Sale and Investment Solicitation Process (the "Second SISP"). Please refer to the Sale and Investment Solicitation Process section of this website for further information. On April 3, 2025, MFM obtained an order extending the Stay Period until and including July 31, 2025. Pursuant to the transactions contemplated by the amended and restated share subscription agreement between Myra Falls Mine Ltd. ("Myra Falls") and Trafigura Holding S.Ã .r.l. and the Reverse Vesting Order granted by the Supreme Court of British Columbia on July 10, 2025, unless expressly retained, all liabilities of Myra Falls have been transferred to 2750361 Alberta Inc. ("Residual Co."). On October 3, 2025, Residual Co. was assigned into bankruptcy pursuant to section 49(1) of the Bankruptcy and Insolvency Act and FTI Consulting Canada Inc. was appointed as the trustee (the "Trustee").
