On August 21, 2026, the Supreme Court of British Columbia issued an order (the "Initial Order") commencing proceedings under the Companies' Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended (the "CCAA") in respect of Western Potash Corp., Western Potash Holdings Corp. and 0907414 B.C. Ltd. (collectively, the "Debtors"). The Initial Order granted, among other things, an initial stay of proceedings in favour of the Debtors until and including August 31, 2026, which may be extended by further order of the Court from time to time. FTI Consulting Canada Inc. is the Court-appointed monitor (the "Monitor") of the Debtors.

On August 31, 2026, the Debtors obtained an amended and restated initial order (the "ARIO") extending the period of the Court-ordered stay of proceedings against the Debtors under the CCAA until December 18, 2026.
