Just Energy Group Inc. et al (the "Plaintiffs") are requesting that the U.S. Bankruptcy Court for the Southern District of Texas (Houston Division) (the "Court") enter judgment in favour of the Plaintiffs and against the Electric Reliability Council of Texas and the Public Utility Commission of Texas, Inc. (collectively, the "Defendants"), and: a) Grant relief under sections 502(d), 542(a), 549, 553, 558, 1507(a), 1520(a), and 1521(a)(7) of the U.S. Bankruptcy Code; b) Award recovery of all Transfers in an amount not less than $274 million; c) Award such other and further relief, in law and equity, as this Court deems just and proper; and d) Award damages to Plaintiffs in an amount to be proven at trial, including prejudgment and post-judgment interest and attorneys' fees to the extent awardable. | |
