FIGR Brands, Inc. - Reports

The following reports have been filed in the proceedings:

 Ninth Report of the Monitor April 14, 2022
The purpose of the Ninth Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable April 21, 2022 seeking an order approving among other things:
i. authorizing each of the Applicants to file an assignment in bankruptcy under the Bankruptcy and Insolvency Act;
ii. authorizing FTI Consulting Canada Inc. ("FTI") to act as trustee-in-bankruptcy of each of the Applicants;
iii. terminating the CCAA Proceedings upon the filing of a certificate (the "Discharge Certificate") by the Monitor;
iv. extending the Stay Period until the filing of the Discharge Certificate;
v. approving this Ninth Report, the activities of the Monitor and its counsel referred to herein, and the fees and disbursements of the Monitor and its counsel.
(b) information regarding the activities of the Monitor and the FIGR Group since January 27, 2022, the date of the Eighth Report; and
(c) a summary of the receipts and disbursements of the FIGR Group for the 11-week period ending April 8, 2022.

 
 Eighth Report of the Monitor January 27, 2022
The purpose of the Eighth Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable February 2, 2022 seeking an order approving among other things:
I. extending the Stay Period until April 29, 2022;
II. approving the Proposed Distribution Methodology;
III. authorizing the Applicants to make one or more cash distributions to each claimant with a Proven Claim;
IV. declaring WEPPA; and
V. approving this Eighth Report approving this Eighth Report, the activities of the Monitor and its counsel, and the fees and disbursements of the Monitor and its counsel
(b) information regarding the activities of the Monitor and the FIGR Group since October 14, 2021, the date of the Seventh Report; and
(c) a summary of the receipts and disbursements of the FIGR Group for the 16-week period ending January 21, 2022.

 
 Seventh Report of the Monitor October 14, 2021
The purpose of the Seventh Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable October 19, 2021 seeking, approval of, among other things:
(i) an Order approving, among other things:
(A) an extension of the Stay Period to February 4, 2022;
(B) approving this Seventh Report as well as the activities of the Monitor, and the fees and disbursements of the Monitor and its counsel
(b) information regarding the activities of the Monitor and the FIGR Group since August 19, 2021; and
(c) a summary of the receipts and disbursements of the FIGR Group for the eight week period ending October 1, 2021.

 
 Sixth Report of the Monitor August 19, 2021
The purpose of the Sixth Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable August 24, 2021 seeking, approval of, among other things:
(i) an Order approving, among other things:
(A) an extension of the Stay Period to October 29, 2021;
(B) approving a Norfolk KERP; and
(C) approving this Sixth Report as well as the activities of the Monitor, and the fees and disbursements of the Monitor and its counsel
(b) information regarding the activities of the Monitor and the FIGR Group since June 4, 2021; and
(c) a summary of the receipts and disbursements of the FIGR Group for the eleven week period ending August 6, 2021.

 
 Fifth Report of the Monitor June 4, 2021
The purpose of the Fifth Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable June 9, 2021 seeking, approval of, among other things:
(i) an Order approving the sale of CIG;
(ii) an Order approving the sale of Norfolk;
(iii) an Order approving, among other things:
(A) an extension of the Stay Period to September 3, 2021;
(B) certain amendments to the DIP facility;
(C) the Proposed Pre-Filing Intercompany Claims Resolution; and
(D) the Monitor's Fifth Report and the activities of the Monitor, as well as the fees and disbursements of the Monitor and its counsel
(b) information regarding the activities of the Monitor and the FIGR Group since April 27, 2021; and
(c) a summary of the receipts and disbursements of the FIGR Group for the nine week period ending May 21, 2021.

 
 Fourth Report of the Monitor April 27, 2021
The purpose of the Fourth Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable April 30, 2021 seeking, approval of, among other things:
(i) an Order approving an Employee Claims Procedure;
(ii) an Order approving, among other things:
(A) an extension of the Stay Period to June 30, 2021; and
(B) the Monitor's Fourth Report and the activities of the Monitor, as well as the fees and disbursements of the Monitor and its counsel
(b) information regarding the activities of the Monitor and the FIGR Group since March 26, 2021; and
(c) a summary of the receipts and disbursements of the FIGR Group for the four week period ending April 16, 2021.

 
 Third Report of the Monitor March 26, 2021
The purpose of the Third Report of the Monitor is to provide the Court:
(a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable March 31, 2021 seeking, approval of, among other things:
(i) an order approving certain amendments to the DIP Facility;
(ii) the Monitor's Reports and the activities of the Monitor, as well as the fees and disbursements of the Monitor and its counsel
(b) information regarding the activities of the Monitor and the FIGR Group since February 18, 2021; and
(c) a summary of the receipts and disbursements of the FIGR Group for the five week period ending March 19, 2021.

 
 Second Report of the Monitor February 18, 2021
The purpose of the Second Report of the Monitor is to provide the Court:
a) the Monitor's comments and recommendations, regarding the FIGR Group's motion returnable February 22, 2021 seeking, approval of, among other things:
(i) an Order approving a claims procedure;
(ii) an Ancillary Order approving, among other things:
A) a key employee retention plan for certain employees of the FIGR Group;
B) an extension of the Stay Period to April 30, 2021; and
C) the Monitor's Reports and the activities of the Monitor, as well as the fees and disbursements of the Monitor and its counsel
b) information regarding the activities of the Monitor and the FIGR Group since January 27, 2021; and
c) a summary of the receipts and disbursements of the FIGR Group for the four week period ending February 12, 2021.

 
 First Report of the Monitor January 27, 2021
The purpose of the First Report of the Monitor is to provide the Court with the Monitor's comments and recommendations, regarding the following:
a) the activities of the Monitor since the issuance of the Initial Order; and
b) the FIGR Group's motion returnable at the Comeback Hearing seeking to:
(i) approve the Sale and Investment Solicitation Process;
(ii) approve the amended and restated Initial order;
(iii) extend the Stay Period to and including March 31, 2021.

 
 Pre-Filing Report of the Proposed Monitor January 21, 2021
The purpose of the Pre-Filing Report of the Proposed Monitor is to inform the court, inter alia:
a) an overview of the FIGR Group's business and affairs, the events leading up to the CCAA Proceedings and the FIGR Group's restructuring efforts to date;
b) the FIGR Group's proposed charges;
c) the FIGR Group's request for the approval of a $8 million debtor-in-possession credit facility;
d) the FIGR Group's consolidated cash flow projections of its receipts and disbursements to April 16, 2021;
e) discussion of the FIGR Group's intended next steps in the CCAA Proceedings; and
g) the Monitor's conclusions and recommendation with respect to the proposed CCAA Proceedings and certain of the relief sought in the Proposed Initial Order.
