Antibe Therapeutics Inc. - Claims Procedure
PLEASE TAKE NOTICE that on June 24, 2024, the Ontario Superior Court of Justice (Commercial List) issued an order (the "Claims Procedure Order") in the Receivership proceedings (the "Receivership Proceedings") of Antibe Therapeutics Inc. (the "Company"). The Claims Procedure Order commences a claims procedure (the "Claims Procedure") for the purpose of identifying and determining all Claims against the Company and its respective Directors and Officers. Please review the Claims Procedure Order in its entirety. All capitalized terms not otherwise defined herein shall have the meanings ascribed to them in the Claims Procedure Order, which is posted below and in the Court Orders section of this website.
Please note that this Claims Procedure pertains to all Persons wherever situated in Canada, the United States, or other jurisdictions, and all Claims must be filed within this Claims Procedure in the Receivership Proceedings using the applicable forms and schedules appended to the Claims Procedure Order approved by the Canadian Court.
PLEASE TAKE NOTICE that the Claims Procedure Order requires that all Persons who wish to assert a Claim against any of the Company or any of their Directors and/or Officers (a "D&O Claim") must file a Proof of Claim with the Receiver, on or before 1:00 p.m. (Toronto time) on August 30, 2024 (the "Claims Bar Date").
The Receiver will send or cause to be sent, on or before July 2, 2024 a General Claims Package (that will include the form of Proof of Claim) to any Person known to the Company or the Receiver as having a potential Claim based on the books and records of the Company. The Receiver will also send a General Claims Package to any Person who requests a Proof of Claim.
It is your responsibility to ensure that the Receiver receives your Proof of Claim by the Claims Bar Date if you wish to assert any Claim. CLAIMS WHICH ARE NOT RECEIVED BY THE APPLICABLE CLAIMS BAR DATE WILL NOT BE ACCEPTED AND SUCH CLAIMS WILL BE BARRED AND EXTINGUISHED FOREVER.
Proofs of Claim must be delivered to the Receiver by prepaid ordinary mail, registered mail, courier, personal delivery, facsimile transmission or email at one of the following applicable addresses noted below and in accordance with the requirements detailed within such forms:
