On February 7,2013, Extreme Fitness, Inc. (the “Applicant”) sought and obtained a stay of proceedings under the Companies’ Creditors Arrangement Act (the “CCAA”). Pursuant to the Initial Order, FTI Consulting Canada Inc. (“FTI” or the “Monitor”) has been appointed Monitor. By Order of the Court on July 11, 2013, the CCAA Proceedings have been terminated pending the filing by the Monitor of the Monitor’s Discharge Certificate. On November 6, 2013, the Monitor filed its Discharge Certificate with the Court certifying that all matters to be attended to in connection with the CCAA Proceedings have been completed to the satisfaction of the Monitor. Pursuant to the Order issued by the Court on July 11, 2013, the filing of the Monitor’s Discharge Certificate terminates the CCAA Proceedings.
